A man in New York recently scared off some gang members by firing a couple of warning shots into the ground. When the cops arrived, did they congratulate the man for protecting his family and start looking for the thugs? That’s what would happen in a logical and just society, but the anti-gun mentality in New York is so pervasive that the cops actually arrested the homeowner. Needless to say, I can’t imagine this happening in Georgia or Wyoming – places where both the law and cops seem to be more rational. Some day, I hope to be on a jury and have a case like this so I can vote not guilty and engage in the noble tradition of jury nullification. Here’s an excerpt from the story I saw on Drudge.
He was arrested for protecting his property and family. But it’s how the Long Island man did it that police say crossed the line. …George Grier said he had to use his rifle on Sunday night to stop what he thought was going to be an invasion of his Uniondale home by a gang he thought might have been the vicious “MS-13.” He said the whole deal happened as he was about to drive his cousin home. “I went around and went into the house, ran upstairs and told my wife to call the police. I get the gun and I go outside and I come into the doorway and now, by this time, they are in the driveway, back here near the house. I tell them, you know, ‘Can you please leave?’ Grier said. Grier said the five men dared him to use the gun; and that their shouts brought another larger group of gang members in front of his house. “He starts threatening my family, my life. ‘Oh you’re dead. I’m gonna kill your family and your babies. You’re dead.’ So when he says that, 20 others guys come rushing around the corner. And so I fired four warning shots into the grass,” Grier said. …You may think a person has the right to defend their home. But the law says you can only use physical force to deter physical force. Grier said he never saw anyone pull out a gun, so a court would have to decide on firing the gun. Police determined Grier had the gun legally. He has no criminal record. And so he was not charged for the weapon.

I am afraid there would have been a dead cop. They violated his second ammendment rights. Any time a cop makes an illegal arrest he is commiting a feloney. The Federal courts have ruled that you have the right to defend yourself with wht ever force necasary even if its a cop if he is commiting a feloney. There is no if, or except in the second ammendment. All and I mean all gun control laws are unconstitutional!!! Period, end of discussion.
Do these police work for a sherrif that is elected? If so, there would be plenty of reason to hand out flyers come poll time.
Once again I say, it is the government attempting get people to obey without question. It is necessary for socialism to get a firm hold on citizens. They couldn’t do it with the iron fist as in Germany because Americans used to be free thinkers. So, they added laws, one at a time, to divest us of our rights. We did not notice because the initial rules were innocuous. But, now they are truly invasive and we are taking notice; I hope it is not too late.
You are automatically guilty, the authorities only have to decide the crime to prosecute.

I have a hearing on mine today I was arrested in Enid, ok for aggravated assault for allegedly breaking the jaw of a man that while inside my house pursued me and laid hands on me when i tried to leave a conflict. I am permenantly partially disabled and was so at that time. I had back and knee injuries that left me with a permenant 10lb lifting restriction. This restriction was proven valid when less than one year after I am accused of doing this i was lifting an object and ut weighed approximately 20lb and the weight of it was enough to disable 37% off my entire body. The individual I am accussed of hurting is an insulin dependant diabetic that does not take care of his condition properly, had oral diseases, and was also somehow able to make it approximately 3 days without seeking medical attention. When admitted at the emergency room days later with no food his blood sugar level was peerfect. According to how they check it normal is between 80 and 120 and his was 105. He was sen after the conflict and before the hospital eating a salad. As wel as seen by others with no bruising, no swelling and no difficulty talking. However the claim is that his jaw was broken so badly it required surgery, screws, plating, and 3 teeth being pulled.
This is one of those incredible moments that should have people barraging their representatives with phone calls and emails to change a really stupid law. But it gets drowned out in the inane babble that is “the media.”
We will hear more about gay marriage (what should be a non-issue) than about the ability to defend your home against gangs.
I know of a woman who’s son barricaded himself in a room with a shotgun when an intruder threatened him. The man broke into the room and her son shot him dead. Her son is now in prison. Maybe IJ could take up the case?
